Party wall and neighbourly matters

Party Wall and neighbourly matters

The Party Wall etc Act 1996 confers certain rights and obligations on owners regarding work to party walls, excavation close to structures and construction on boundaries. In addition, it provides a structure for the prevention and resolution of disputes between neighbours, through the appointment of surveyors who must take a practical and impartial view within the framework of the Act to ensure the work is carried out in a manner that protects the rights of all parties involved.

Cluttons' project and building consultancy team has significant professional experience of work under the Party Wall etc Act and offers the following services:

  • general advice on whether the Act is applicable and its operation
  • acting as building, adjoining and agreed surveyors
  • serving notices and awards
  • tenant and owner searches
  • neighbourly negotiation
