Cluttons agrees Statutory Compensation for Cellnex following Compulsory Purchase by Highways England as part of the A1 Road Widening
Cellnex instructed Cluttons who are engaged to advise Cellnex on Compulsory Purchase across the United Kingdom to represent the company in negotiations with Highways England on their Catterick Telecoms Mast Site which was acquired as part of the A1 Motorway (Dishforth to Barton Section) CPO.
Through an understanding of the Cellnex relocation to an alternative site as a result of the CPO, including the need for a temporary mast site whilst planning and lease terms were agreed for a new site, we were able to agree compensation of £500k, which captured all of Cellnex’s disturbance compensation over a 6-year period as a result of the CPO and through proper management of the process ensured Network coverage was continued throughout.

Explaining and advising on compulsory purchase, principles, and heads of claim.
Securing fee undertakings from Highways England for professional advisors to ensure Cellnex incurred no cost for receiving expert advice.
All aspects of building a justified and supported compensation claim, including the need for a good paper trail of evidence and demonstration of reasonableness and duty to mitigate.
Entering into negotiations with Highways England
Reaching agreement with Highways England at compensation figure which ensured that Cellnex were in no worse position financially as a result of the CPO.
